Summary of research
Modern transactions are multifaceted and typically involve a plurality of parties and contracts. However, the core of international adjudication still lies on the consensual principle, which is inextricably woven into the bilateralism of litigation and seems often unable to accommodate the modern transactions. Against this background, the indispensable third-party principle comes into play and raises questions of judicial propriety. The project aims to explore this principle, in particular its applicability in investment arbitration where investments on disputed territories are at stake, and propose conceivable tools that would allow international Courts and Tribunals to deal effectively with multilateral disputes.
Biography
Lucia is a PhD candidate and Attorney at Fietta LLP. Lucia has a solid background in international arbitration and international law. Her pluriannual experience includes working in top-tier law firms in London and Milan and in International Courts and Tribunals in Paris, Washington DC and Hamburg, focusing on international dispute resolution matters, investment and commercial arbitration and public international law.
Lucia graduated top of her class (summa cum laude) from the University of Bologna and holds a Master 2 in Transnational Arbitration & Dispute Settlement from Sciences Po in Paris (summa cum laude).
