SOLM353 Investment Treaty Arbitration: Investor Claims and State Defences

Module description

The module will discuss the legal basis of the investors’ substantive claims and state defences in investment treaty Arbitration. It will analyse the treaty substantive protection standards such as protection against unlawful expropriation and fair and equitable treatment. It will also present the State’s perspective and the typical defences a State can raise in response to the investors’ claims. The module will also analyse the topic of arbitral decision-making and the methods the investment Tribunals use to decide the disputes.
